{"id":12954,"date":"2017-05-04T16:13:00","date_gmt":"2017-05-04T13:13:00","guid":{"rendered":"https:\/\/adcmemorial.org?p=12954"},"modified":"2019-08-19T18:58:05","modified_gmt":"2019-08-19T15:58:05","slug":"imprisoned-stateless-persons-in-russia-the-search-for-a-way-out-of-a-legal-dead-end","status":"publish","type":"post","link":"https:\/\/adcmemorial.org\/en\/news\/imprisoned-stateless-persons-in-russia-the-search-for-a-way-out-of-a-legal-dead-end\/","title":{"rendered":"Imprisoned Stateless Persons in Russia: The Search for a Way Out of a Legal Dead End"},"content":{"rendered":"<p><em><span lang=\"en-US\">May<\/span> 4, 2017, <span lang=\"en-US\">Budapest<\/span>.<\/em><\/p>\n<p><span lang=\"en-US\">At <a href=\"http:\/\/www.statelessness.eu\/news-events\/news\/lockedinlimbo-it-s-time-end-arbitrary-detention-stateless-people-europe\">the Yearly Conference<\/a> of the European Network on Statelessness, <\/span><span lang=\"en-US\">the expert of ADC Memorial made <a href=\"https:\/\/adcmemorial.org\/wp-content\/uploads\/Presentation-Stateless_Kulaeva_5-May-2017-Budapest.pptx\">a presentation on the situation of stateless persons in Russia<\/a><\/span><span lang=\"en-US\"> and on a new step in litigation in the interests of these people \u2013 <a href=\"https:\/\/adcmemorial.org\/www\/12930.html?lang=en\">the hearings <\/a>at the Constitutional Court of the RF that took place in April, 2017. <\/span><\/p>\n<p><span lang=\"en-US\">A new publication of ADC Memorial was presented at the Conference, <a href=\"https:\/\/adcmemorial.org\/wp-content\/uploads\/detention_ENG.pdf\">\u201cImprisoned Stateless Persons in Russia: The Search for a Way Out of a Legal Dead End\u201d<\/a>, <\/span><span lang=\"en-US\">containing an up-date of the Human Rights report <a href=\"https:\/\/adcmemorial.org\/www\/publications\/human-rights-report-of-adc-memorial-violations-of-the-rights-of-stateless-persons-and-foreign-citizens-in-temporary-foreign-national-detention-centers-in-light-of-the-echr-judgment-in-kim-v-russia?lang=en\">\u201cViolations of the Rights of Stateless Persons and Foreign Citizens in Light of the ECHR Judgment in \u201cKim v. Russia\u201d<\/a><\/span> <span lang=\"en-US\">(2016).<\/span><\/p>\n<p><span lang=\"en-US\">In the new report, the next step of litigation in the interests of the stateless persons is analyzed, which is the observation of the case of Noe Mskhiladze by he Constitutional Court of the RF on April 18, 2017. The ruling is pending, but during the hearings the lawyers defending Mschiladze with the support of ADC Memorial presented their position; the articles 31.7 and 31.9 of the Administrative Code contradict the Constitution (according to these articles, stateless people are detained in SITDFNs for up to 2 years, having no access to legal aid, waiting for expulsion prescribed by court, but they can\u2019t be expelled anywhere). Representatives of state institutions didn\u2019t agree with this position, but many of them agreed that the rights of the applicant were violated. <\/span><\/p>\n<p><span lang=\"en-US\">The second part of the new report, \u201cThe life in SITDFN <\/span><span lang=\"en-US\">through the eyes of a prisoner\u201d, is based on photos and comments made by Viktor Nigmatulin, a stateless person who has been detained in Kemerovo SITDFN for many months. <\/span><span lang=\"en-US\"> The Ministry of Justice recognized him as \u201cunwanted in the Russian Federation\u201d (as in case of Mskhiladze), that\u2019s why his situation gets much worse. <\/span><\/p>\n<p><span lang=\"en-US\">The legislation should be changed in order to stop the discriminative practice of detaining stateless people and to make legalization and documenting them possible. In 2014, about such general measures there was a ruling of the ECHR on the case \u201cKim vs Russia\u201d (won by the lawyers with the support if ADC Memorial). The Russian government hasn\u2019t implemented the ruling so far, however, during the hearings at the Constitutional Court the authorities\u2019 representatives conformed that the changes of the Administrative Code are planned for December, 2017, and there is a hope that since that time the courts will stop to produce rulings on expulsion and detention of stateless persons. <\/span><\/p>\n<p><span lang=\"en-US\">But the problem of legalization and documentation of stateless persons remains unsolved, that\u2019s why the implementation of the ECHR ruling is crucial for hundreds thousands stateless persons who live in Russia and have no rights. <\/span><\/p>\n<p><iframe title=\"Imprisoned Stateless Persons in Russia: The Search for a Way Out of a Legal Dead End\" src=\"https:\/\/e.issuu.com\/embed.html?u=adcmemorial1&#038;d=detention_eng\" style=\"border:none; width: 640px; height: 491px;\" allow=\"clipboard-write,allow-top-navigation,allow-top-navigation-by-user-activation,allow-downloads,allow-scripts,allow-same-origin,allow-popups,allow-modals,allow-popups-to-escape-sandbox,allow-forms\"  allowfullscreen=\"true\"><\/iframe><\/p>\n","protected":false},"excerpt":{"rendered":"<p>May 4, 2017, Budapest.
