\u201dWhen I remember the things that happened to me my heart stops beating.\u201d<\/em>
\n\u2014<\/em> A former prisoner recalls his time in detention.<\/em><\/p>\n<\/blockquote>\n

The<\/span> NGOs<\/span> jointly<\/span> issuing<\/span> this<\/span> statement<\/span> urge<\/span> the<\/span> Uzbekistani<\/span> authorities<\/span> to<\/span> live<\/span> up<\/span> to<\/span> their<\/span> international human rights obligations by decriminalizing homosexuality. <\/span><\/strong>Article 120<\/a> of the current Criminal Code punishes<\/span> consensual<\/span> sexual<\/span> relations<\/span> between<\/span> adult<\/span> men<\/span> by<\/span> up<\/span> to<\/span> three<\/span> years\u2019<\/span> imprisonment.<\/span> Uzbekistan is currently drafting a new Criminal Code and should take this opportunity to improve its human rights record and remove legislation that punishes individuals for the peaceful exercise of their fundamental human<\/span> rights.<\/span><\/strong><\/p>\n

We call on the Uzbekistani government to repeal legislation that punishes consensual sexual relations between adult men and that is used to repress individuals\u2018 freedom, personal security and privacy and persecute them for peaceful exercise of human rights including the right to life. The authorities should also<\/span> combat<\/span> existing<\/span> stigma<\/span> and<\/span> discrimination<\/span> of<\/span> LGBTI<\/span> persons<\/span> by<\/span> actively<\/span> increasing<\/span> public<\/span> awareness about human<\/span> rights.<\/span><\/p>\n

As a party to the International Covenant on Civil and Political Rights Uzbekistan has committed itself to ensure<\/span> that<\/span> everybody<\/span> can<\/span> exercise<\/span> their<\/span> rights<\/span> without<\/span> distinction<\/span> of<\/span> any<\/span> kind,<\/span> \u201csuch<\/span> as<\/span> race,<\/span> colour,<\/span> sex, language, religion, political or other opinion, national or social origin, property, birth or other status.\u201c In their<\/span> concluding<\/span> observations<\/span> issued<\/span> in<\/span> January <\/a>and May <\/a>\u00a02020,<\/span> both<\/span> the<\/span> United<\/span> Nations<\/span> (UN)<\/span> Committee against Torture and the UN Human Rights Committee called on Uzbekistan to repeal Article<\/span> 120.<\/span><\/p>\n

\u201dWhen I found out that my son is gay, I was thrown into a blind panic. I dragged him to imams, and to psychologists to try to \u201cheal\u201c him. But all I did was hurt him and spoil his life. Now I understand that homosexuality is not an illness. He is still the same handsome, clever and peaceful person. He simply happens to love people of his own sex, that\u2019s all! But because of this, many want to kill him, burn him, stone him. As long as Article 120 exists my son and other LGBT people will not be able to live quietly and be happy. I believe that revoking Article 120 will only lead to good \u2013 for everyone.\u201c
\n<\/span><\/em>\u2014 <\/span>Mother of a young gay man calling on her fellow citizens not to be afraid of people with same-sex relations.<\/span><\/em><\/p>\n<\/blockquote>\n

<\/a> A young man who in recent years was imprisoned under Article 120 and has since been released, reports that he does not know how to live with the trauma of having been beaten and treated with hatred and contempt each day. In pre-trial detention he was regularly subjected to violence by other detainees while the guards looked the other way. He recalled that the days spent in pre-trial detention \u201cwere the most awful and disgusting in my life\u201d and that officers beat and attempted to rape him with a truncheon when he first arrived at the prison colony.<\/span><\/p>\n

Article 120 poses a constant threat to gay and bisexual men in their daily lives and makes it impossible for them to lodge complaints with the authorities about violence and discrimination to which they are subjected, for fear of revealing their sexual orientation. Groups defending the human rights of LGBTI persons are unable to operate safely in Uzbekistan and the authorities suppress all attempts to draw attention to human rights violations affecting LGBTI persons.<\/span><\/p>\n

A gay man from Uzbekistan said on condition of anonymity:<\/span><\/p>\n

\n

\u201cArticle 120 gives people the right to abuse and discriminate with impunity against<\/span> persons<\/span> with<\/span> a<\/span> non-traditional<\/span> sexual<\/span> orientation<\/span> or<\/span> gender<\/span> identity.
\n<\/span>It also provides the ideal breeding ground for corruption. As long as this article exists, we will have to live in fear and homophobes will have power overus.\u201d<\/em><\/p>\n<\/blockquote>\n

Police do not press charges against all the gay and bisexual men whom they track down, but often threaten<\/span> to<\/span> imprison<\/span> them<\/span> or<\/span> disclose<\/span> their<\/span> sexual<\/span> orientation<\/span> to<\/span> their<\/span> families<\/span> for<\/span> blackmail<\/span> and<\/span> financial extortion purposes. Police also coerce LGBTI people to collaborate with them to identify wealthier gay and bisexual men. In this way many LGBTI persons in Uzbekistan feel they have no option but to lead double lives – they stand to pay a steep price if their wives, husbands, parents, other relatives or neighbours learn about their sexual orientation or gender<\/span> identity.<\/span><\/p>\n

Homophobic<\/span> mobs<\/span> frequently<\/span> target<\/span> LGBTI<\/span> individuals<\/span> and<\/span> those<\/span> perceived<\/span> to<\/span> be<\/span> gay,<\/span> subjecting<\/span> them<\/span> to physical abuse and extortion. On internet-based messaging services homophobic activists disseminate the<\/span> names<\/span> and<\/span> contact<\/span> details<\/span> of<\/span> gay<\/span> and<\/span> bisexual<\/span> men<\/span> and<\/span> those<\/span> perceived<\/span> to<\/span> be<\/span> gay<\/span> and<\/span> call<\/span> for<\/span> them to be \u201cpunished\u201d and killed. Videos of such beatings have been disseminated and there are credible reports that several gay men have been murdered or severely injured by homophobic mobs in recent years.<\/span><\/p>\n

Police<\/span> are<\/span> also<\/span> known<\/span> to<\/span> exploit<\/span> the<\/span> fear<\/span> of<\/span> being<\/span> labelled<\/span> as<\/span> \u201cgay\u201d<\/span> (an<\/span> accusation<\/span> perceived<\/span> as<\/span> extremely shameful in Uzbekistani society) by extending the threat of imprisonment under Article 120 beyond gay and bisexual, to heterosexual and pious Muslim men. The NGOs jointly issuing this statement are aware<\/span> of<\/span> several<\/span> cases<\/span> in<\/span> recent<\/span> years<\/span> when<\/span> police<\/span> forced<\/span> individuals<\/span> to<\/span> hand<\/span> over<\/span> large<\/span> sums<\/span> of<\/span> money or property or to \u201cconfess\u201d to serious crimes including \u201cterrorism\u201d or \u201cattempting to overthrow the constitutional order\u201d, to avoid being charged with Article<\/span> 120.<\/span><\/p>\n

Human<\/span> rights<\/span> violations<\/span> including<\/span> sexual<\/span> violence<\/span> against<\/span> gay<\/span> and<\/span> bisexual<\/span> men<\/span> and<\/span> those<\/span> perceived<\/span> to be<\/span> gay,<\/span> are<\/span> particularly<\/span> egregious<\/span> in<\/span> penitentiary<\/span> institutions.<\/span> These<\/span> men<\/span> are<\/span> frequently<\/span> victims<\/span> of<\/span> torture and other forms of ill-treatment inflicted by police officers, National Security Service officers, prison guards<\/span> and<\/span> fellow<\/span> inmates.<\/span> Torture<\/span> methods<\/span> include<\/span> rape<\/span> with<\/span> bottles<\/span> and<\/span> truncheons,<\/span> attaching<\/span> heavy water<\/span> bottles<\/span> to<\/span> the<\/span> detainee\u2019s<\/span> genitals,<\/span> wrapping<\/span> newspaper<\/span> around<\/span> the<\/span> genitals<\/span> and<\/span> setting<\/span> the<\/span> paper on fire. Gay and bisexual prisoners and those suspected or accused of same-sex relations have the lowest<\/span> status<\/span> in<\/span> the<\/span> informal<\/span> but<\/span> strictly<\/span> imposed<\/span> prisoner<\/span> hierarchy.<\/span> They<\/span> are<\/span> regularly<\/span> used<\/span> as<\/span> \u201cslaves\u201d by guards and other inmates and, for example, are forced to clean dirty toilets with their bare<\/span> hands.<\/span><\/p>\n

The Uzbekistani authorities have on several occasions<\/span> stated <\/a>that homosexuality is contrary to Islam and<\/span> the<\/span> country\u2019s<\/span> traditional<\/span> values<\/span> and<\/span> cultural<\/span> norms,<\/span> and<\/span> that<\/span> the<\/span> public<\/span> is<\/span> not<\/span> ready<\/span> to<\/span> repeal<\/span> Article 1201<\/a><\/sup>See, for example: Human Rights Committee 128th session, Summary record of the 3690th meeting, Consideration of reports submitted by States parties under article 40 of the Covenant, Fifth periodic report of Uzbekistan, 5 March 2020, para. 50<\/span>. <\/span>However, governments cannot use religion, tradition and culture as an excuse to circumvent their human rights obligations. Muslim majority countries that have legalized homosexuality include Uzbekistan\u2019s neighbours Kazakhstan, Kyrgyzstan and Tajikistan, as well as Azerbaijan and Turkey.<\/p>\n
