{"id":23332,"date":"2021-07-08T14:24:08","date_gmt":"2021-07-08T11:24:08","guid":{"rendered":"https:\/\/adcmemorial.org\/?p=23332"},"modified":"2021-07-08T15:27:11","modified_gmt":"2021-07-08T12:27:11","slug":"building-back-better-for-stateless-people","status":"publish","type":"post","link":"https:\/\/adcmemorial.org\/en\/news\/building-back-better-for-stateless-people\/","title":{"rendered":"Building Back Better For Stateless People"},"content":{"rendered":"<p><strong>This joint statement is an urgent call to States, UN agencies, donors and other stakeholders to learn lessons from the COVID-19 pandemic and take sustained action to correct past mistakes and prioritise protecting stateless people\u2019s rights and the right to nationality.<\/strong><\/p>\n<p>In June 2020, 84 civil society actors issued a <strong><a href=\"https:\/\/www.institutesi.org\/resources\/joint-statement-in-solidarity-with-the-stateless\" target=\"_blank\" rel=\"noopener\">joint statement \u2018In Solidarity with the Stateless\u2019<\/a><\/strong> calling on: States, UN agencies, human rights, humanitarian and public health actors, donors and the media to address the devastating impact of the COVID-19 pandemic on stateless people and those at risk of statelessness. One year on, the concerns expressed in that statement remain largely unaddressed, with the situation of stateless people further deteriorating, partly due to failures to acknowledge and respond to their specific contexts and uphold their rights. Moreover, new concerns and challenges, particularly around vaccine inequity, have also emerged. The <strong>106 civil society actors<\/strong>, co-signatories to this statement, are deeply concerned that many States and other key stakeholders have been unable or unwilling to learn from past mistakes and have failed to adequately prioritise and resource the practical steps that can and must be taken to protect stateless people and the right to nationality.<\/p>\n<p><span id=\"page641R_mcid23\" class=\"markedContent\"><span dir=\"ltr\">Since the beginning of the pandemic, we have witnessed the cost of <\/span><\/span><span id=\"page641R_mcid24\" class=\"markedContent\"><span dir=\"ltr\">institutional and public ignorance and structural violence towards stateless <\/span><\/span><span id=\"page641R_mcid25\" class=\"markedContent\"><span dir=\"ltr\">people (and those at risk of statelessness) and remain deeply concerned <\/span><\/span><span id=\"page641R_mcid26\" class=\"markedContent\"><span dir=\"ltr\">about the lasting detrimental impact on an estimated 15 million stateless <\/span><\/span><span id=\"page641R_mcid27\" class=\"markedContent\"><span dir=\"ltr\">people worldwide, and tens of millions whose nationality is under threat. As <\/span><\/span><span id=\"page641R_mcid28\" class=\"markedContent\"><span dir=\"ltr\">observed in the 2020 joint statement, the entrenched structural problems <\/span><\/span><span id=\"page641R_mcid29\" class=\"markedContent\"><span dir=\"ltr\">that stateless people and those at risk of statelessness face in \u2018normal\u2019 times <\/span><\/span><span id=\"page641R_mcid30\" class=\"markedContent\"><span dir=\"ltr\">contributed to their disproportionate suffering and exclusion during the <\/span><\/span><span id=\"page641R_mcid31\" class=\"markedContent\"><span dir=\"ltr\">pandemic. COVID-19 measures, including border closures and movement <\/span><\/span><span id=\"page641R_mcid32\" class=\"markedContent\"><span dir=\"ltr\">restrictions, discriminated against stateless people, who were also largely <\/span><\/span><span id=\"page641R_mcid33\" class=\"markedContent\"><span dir=\"ltr\">excluded from health assistance, emergency relief and economic support <\/span><\/span><span id=\"page641R_mcid34\" class=\"markedContent\"><span dir=\"ltr\">packages. Disruptions to birth and civil registrations affected access to <\/span><\/span><span id=\"page641R_mcid35\" class=\"markedContent\"><span dir=\"ltr\">nationality, while NGOs and community groups working on nationality rights <\/span><\/span><span id=\"page641R_mcid36\" class=\"markedContent\"><span dir=\"ltr\">issues faced serious disruptions to their operations and funding. As some <\/span><\/span><span id=\"page641R_mcid37\" class=\"markedContent\"><span dir=\"ltr\">leaders exploited the pandemic to grab more power, increase surveillance <\/span><\/span><span id=\"page641R_mcid38\" class=\"markedContent\"><span dir=\"ltr\">and derogate from human rights obligations under declared states of <\/span><\/span><span id=\"page1R_mcid87\" class=\"markedContent\"><span dir=\"ltr\">emergency, non-citizens and members of minority groups, including those <\/span><\/span><span id=\"page1R_mcid88\" class=\"markedContent\"><span dir=\"ltr\">rendered stateless in their own country, were increasingly scapegoated, <\/span><\/span><span id=\"page1R_mcid89\" class=\"markedContent\"><span dir=\"ltr\">vilified and targeted for hate-speech, arbitrary detention and even expulsion. <\/span><\/span><\/p>\n<p><span id=\"page1R_mcid90\" class=\"markedContent\"><span dir=\"ltr\">One year on, civil society groups have documented the catastrophic impact <\/span><\/span><span id=\"page1R_mcid91\" class=\"markedContent\"><span dir=\"ltr\">of the pandemic and State responses to it on stateless people and those at <\/span><\/span><span id=\"page1R_mcid92\" class=\"markedContent\"><span dir=\"ltr\">risk of statelessness. In particular, the June 2021 report <\/span><\/span><a href=\"https:\/\/files.institutesi.org\/together_we_can_report_2021.pdf\"><span id=\"page1R_mcid93\" class=\"markedContent\"><span dir=\"ltr\">\u2018Together We Can: <\/span><\/span><span id=\"page1R_mcid94\" class=\"markedContent\"><span dir=\"ltr\">The COVID-19 Impact on Stateless People and a Roadmap for Change\u2019<\/span><\/span><\/a><span id=\"page1R_mcid95\" class=\"markedContent\"><span dir=\"ltr\"> by <\/span><\/span><span id=\"page1R_mcid96\" class=\"markedContent\"><span dir=\"ltr\">the COVID-19 Emergency Statelessness Fund Consortium and the April 2021 <\/span><\/span><a href=\"https:\/\/www.statelessness.eu\/sites\/default\/files\/2021-04\/ENS_Health_Situation_Assessment_Europe.pdf\"><span id=\"page1R_mcid97\" class=\"markedContent\"><span dir=\"ltr\">\u2018Situation assessment of statelessness, health, and COVID-19 in Europe\u2019<\/span><\/span><\/a><span id=\"page1R_mcid98\" class=\"markedContent\"><span dir=\"ltr\"> by <\/span><\/span><span id=\"page1R_mcid99\" class=\"markedContent\"><span dir=\"ltr\">the European Network on Statelessness provide empirical evidence in this <\/span><\/span><span id=\"page1R_mcid100\" class=\"markedContent\"><span dir=\"ltr\">regard. These reports also flag emerging good practices in some States, <\/span><\/span><span id=\"page1R_mcid101\" class=\"markedContent\"><span dir=\"ltr\">which all States are urged to follow. Some of the main observations of civil <\/span><\/span><span id=\"page1R_mcid102\" class=\"markedContent\"><span dir=\"ltr\">society groups include:<\/span><\/span><\/p>\n<ul>\n<li><span id=\"page1R_mcid104\" class=\"markedContent\"><span dir=\"ltr\">Stateless people and those whose nationality is at risk are being <\/span><\/span><strong><span id=\"page1R_mcid105\" class=\"markedContent\"><span dir=\"ltr\">denied <\/span><\/span><span id=\"page1R_mcid106\" class=\"markedContent\"><span dir=\"ltr\">equal access to vaccinations<\/span><\/span><\/strong><span id=\"page1R_mcid107\" class=\"markedContent\"><span dir=\"ltr\"> in many countries, including in Bangladesh, <\/span><\/span><span id=\"page1R_mcid108\" class=\"markedContent\"><span dir=\"ltr\">Cameroon, Central Asia, Kenya, Malaysia, Nepal, and some European <\/span><\/span><span id=\"page1R_mcid109\" class=\"markedContent\"><span dir=\"ltr\">countries, despite facing heightened risks of contracting the virus due <\/span><\/span><span id=\"page1R_mcid110\" class=\"markedContent\"><span dir=\"ltr\">to environmental determinants (e.g., inability to socially distance, lack <\/span><\/span><span id=\"page1R_mcid111\" class=\"markedContent\"><span dir=\"ltr\">of PPE, poor sanitation, working in exploitative and dangerous settings) <\/span><\/span><span id=\"page1R_mcid112\" class=\"markedContent\"><span dir=\"ltr\">and having been denied equal access to healthcare and relief. <\/span><\/span><\/li>\n<li><strong><span id=\"page1R_mcid114\" class=\"markedContent\"><span dir=\"ltr\">Access to healthcare<\/span><\/span><\/strong><span id=\"page1R_mcid115\" class=\"markedContent\"><span dir=\"ltr\"> remains a significant challenge, as stateless <\/span><\/span><span id=\"page1R_mcid116\" class=\"markedContent\"><span dir=\"ltr\">people are denied equal access to free or subsidised healthcare or <\/span><\/span><span id=\"page1R_mcid117\" class=\"markedContent\"><span dir=\"ltr\">health insurance in many countries, including the Dominican Republic, <\/span><\/span><span id=\"page1R_mcid118\" class=\"markedContent\"><span dir=\"ltr\">India, Indonesia, Lebanon, Montenegro, Nepal, North Macedonia and <\/span><\/span><span id=\"page1R_mcid119\" class=\"markedContent\"><span dir=\"ltr\">South Africa. In Sweden, access to COVID-19 testing is contingent <\/span><\/span><span id=\"page1R_mcid120\" class=\"markedContent\"><span dir=\"ltr\">upon digital ID. In Kenya, Libya, Thailand and in Europe, where Romani <\/span><\/span><span id=\"page1R_mcid121\" class=\"markedContent\"><span dir=\"ltr\">communities face heightened antigypsyism, the lack of documentation <\/span><\/span><span id=\"page1R_mcid122\" class=\"markedContent\"><span dir=\"ltr\">is a barrier to accessing healthcare. Fear of arrest, detention and police <\/span><\/span><span id=\"page1R_mcid123\" class=\"markedContent\"><span dir=\"ltr\">brutality also undermine access. The mental health impact on stateless <\/span><\/span><span id=\"page1R_mcid124\" class=\"markedContent\"><span dir=\"ltr\">people of dealing with COVID-19 and its consequences is also a matter <\/span><\/span><span id=\"page1R_mcid125\" class=\"markedContent\"><span dir=\"ltr\">of serious concern.<\/span><\/span><\/li>\n<li><span id=\"page1R_mcid127\" class=\"markedContent\"><span dir=\"ltr\">Ongoing delays and backlogs in <\/span><\/span><strong><span id=\"page1R_mcid128\" class=\"markedContent\"><span dir=\"ltr\">civil registration and other vital <\/span><\/span><span id=\"page1R_mcid129\" class=\"markedContent\"><span dir=\"ltr\">procedures<\/span><\/span><\/strong><span id=\"page1R_mcid130\" class=\"markedContent\"><span dir=\"ltr\"> are also leaving stateless people in limbo and create new <\/span><\/span><span id=\"page1R_mcid131\" class=\"markedContent\"><span dir=\"ltr\">risks of statelessness. Such disruptions have been reported, among <\/span><\/span><span id=\"page1R_mcid132\" class=\"markedContent\"><span dir=\"ltr\">others, in the Dominican Republic, Israel and the Occupied Palestinian <\/span><\/span><span id=\"page1R_mcid133\" class=\"markedContent\"><span dir=\"ltr\">Territories, Montenegro, Nepal, North Macedonia, South Africa and <\/span><\/span><span id=\"page1R_mcid134\" class=\"markedContent\"><span dir=\"ltr\">Zimbabwe. Asylum, immigration, and statelessness determination <\/span><\/span><span id=\"page1R_mcid135\" class=\"markedContent\"><span dir=\"ltr\">procedures have been disrupted in several countries, including Bulgaria, <\/span><\/span><span id=\"page1R_mcid136\" class=\"markedContent\"><span dir=\"ltr\">Colombia, Germany and Ukraine. <\/span><\/span><\/li>\n<li><span id=\"page1R_mcid138\" class=\"markedContent\"><span dir=\"ltr\">Exclusion from <\/span><\/span><strong><span id=\"page1R_mcid139\" class=\"markedContent\"><span dir=\"ltr\">emergency relief <\/span><\/span><\/strong><span id=\"page1R_mcid140\" class=\"markedContent\"><span dir=\"ltr\">due to lack of documentation persists <\/span><\/span><span id=\"page1R_mcid141\" class=\"markedContent\"><span dir=\"ltr\">in several countries, including France, Georgia, Kenya, Lebanon, <\/span><\/span><span id=\"page1R_mcid142\" class=\"markedContent\"><span dir=\"ltr\">Montenegro, Nepal, Serbia, the Netherlands, and the United States. In <\/span><\/span><span id=\"page1R_mcid143\" class=\"markedContent\"><span dir=\"ltr\">many countries, the inability to access safe, formal employment and <\/span><\/span><span id=\"page1R_mcid144\" class=\"markedContent\"><span dir=\"ltr\">the resulting consecutive loss of income have also been reported, <\/span><\/span><span id=\"page1R_mcid145\" class=\"markedContent\"><span dir=\"ltr\">pushing many stateless people further into poverty. Such people are <\/span><\/span><span id=\"page1R_mcid146\" class=\"markedContent\"><span dir=\"ltr\">confronted with the impossible choices of doing unlawful, hazardous <\/span><\/span><span id=\"page1R_mcid147\" class=\"markedContent\"><span dir=\"ltr\">and exploitative jobs, or seeing their families starve.<\/span><\/span><\/li>\n<li><strong><span id=\"page1R_mcid149\" class=\"markedContent\"><span dir=\"ltr\">Hate speech, intolerance, xenophobia, antigypsyism, and discrimination <\/span><\/span><\/strong><span id=\"page7R_mcid211\" class=\"markedContent\"><span dir=\"ltr\"><span id=\"page1R_mcid150\" class=\"markedContent\">against minorities who are stateless or at risk of statelessness continue <\/span><span id=\"page1R_mcid151\" class=\"markedContent\">to rise, inter alia, targeting Roma communities in Europe, the Rohingya <\/span><span id=\"page1R_mcid152\" class=\"markedContent\">in Asia, those declared foreigners in Assam, the Bihari community of <\/span><span id=\"page1R_mcid153\" class=\"markedContent\">Bangladesh, Nubians of Kenya, Dominicans of Haitian descent in the <\/span><span id=\"page1R_mcid154\" class=\"markedContent\">Dominican Republic and refugees, migrants and stateless people in <\/span><span id=\"page1R_mcid155\" class=\"markedContent\">South Africa. <\/span><\/span><\/span><\/li>\n<li><span id=\"page7R_mcid211\" class=\"markedContent\"><span dir=\"ltr\"><strong><span id=\"page1R_mcid157\" class=\"markedContent\">Gender discriminatory nationality laws<\/span><\/strong><span id=\"page1R_mcid158\" class=\"markedContent\"> denying women equal rights <\/span><span id=\"page1R_mcid159\" class=\"markedContent\">to confer nationality on their children and spouses in countries such <\/span><span id=\"page1R_mcid160\" class=\"markedContent\">as Lebanon, Malaysia, Nepal and Saudi Arabia have precipitated family <span id=\"page7R_mcid205\" class=\"markedContent\">separations when foreign spouses and children have been unable <\/span><span id=\"page7R_mcid206\" class=\"markedContent\">to renew visas or enter the country, and have also increased the risk <\/span><span id=\"page7R_mcid207\" class=\"markedContent\">of statelessness among children born abroad. Amid an escalation of <\/span><span id=\"page7R_mcid208\" class=\"markedContent\">gender-based violence during the pandemic, gender-discriminatory <\/span><span id=\"page7R_mcid209\" class=\"markedContent\">nationality laws increase the obstacles faced by women seeking to <\/span><span id=\"page7R_mcid210\" class=\"markedContent\">leave abusive relationships when their own nationality or their children\u2019s, <\/span>is dependent upon that of their spouse or the father of their children. <\/span><\/span><\/span><span id=\"page7R_mcid212\" class=\"markedContent\"><\/span><\/li>\n<li><span id=\"page7R_mcid213\" class=\"markedContent\"><span dir=\"ltr\">Stateless people face heightened risks of <\/span><\/span><strong><span id=\"page7R_mcid214\" class=\"markedContent\"><span dir=\"ltr\">harassment, arrest and <\/span><\/span><span id=\"page7R_mcid215\" class=\"markedContent\"><span dir=\"ltr\">arbitrary detention<\/span><\/span><\/strong><span id=\"page7R_mcid216\" class=\"markedContent\"><span dir=\"ltr\">. Stateless people in detention in several countries, <\/span><\/span><span id=\"page7R_mcid217\" class=\"markedContent\"><span dir=\"ltr\">including Australia, Malaysia and Thailand are at high risk of infection <\/span><\/span><span id=\"page7R_mcid218\" class=\"markedContent\"><span dir=\"ltr\">due to the inability to protect themselves through social distancing and <\/span><\/span><span id=\"page7R_mcid219\" class=\"markedContent\"><span dir=\"ltr\">preventative hygiene measures. Rohingya refugees are being denied <\/span><\/span><span id=\"page7R_mcid220\" class=\"markedContent\"><span dir=\"ltr\">access to UNHCR or asylum procedures and are at heightened risk of <\/span><\/span><span id=\"page7R_mcid221\" class=\"markedContent\"><span dir=\"ltr\">arrest and arbitrary detention. In several European countries, procedural <\/span><\/span><span id=\"page7R_mcid222\" class=\"markedContent\"><span dir=\"ltr\">safeguards and effective remedies to challenge immigration detention <\/span><\/span><span id=\"page7R_mcid223\" class=\"markedContent\"><span dir=\"ltr\">were hindered and the risks of detention becoming arbitrary increased. <\/span><\/span><\/li>\n<\/ul>\n<p><span id=\"page7R_mcid224\" class=\"markedContent\"><span dir=\"ltr\">Civil society responses have shown that the challenge of COVID-19 can <\/span><\/span><span id=\"page7R_mcid225\" class=\"markedContent\"><span dir=\"ltr\">be addressed through targeted, community-based action centred around <\/span><\/span><span id=\"page7R_mcid226\" class=\"markedContent\"><span dir=\"ltr\">stateless people\u2019s leadership, participation and expertise. Consequently, we <\/span><\/span><span id=\"page7R_mcid227\" class=\"markedContent\"><span dir=\"ltr\">urge stakeholders to speak directly with stateless activists and communities, <\/span><\/span><span id=\"page7R_mcid228\" class=\"markedContent\"><span dir=\"ltr\">as well as CSOs working closely with them, and to study their research <\/span><\/span><span id=\"page7R_mcid229\" class=\"markedContent\"><span dir=\"ltr\">findings to better understand and respond to the pandemic\u2019s devastating <\/span><\/span><span id=\"page7R_mcid230\" class=\"markedContent\"><span dir=\"ltr\">impacts. <\/span><\/span><\/p>\n<p><span id=\"page7R_mcid231\" class=\"markedContent\"><span dir=\"ltr\">However, without urgent attention, protection and intervention from States, UN <\/span><\/span><span id=\"page7R_mcid232\" class=\"markedContent\"><span dir=\"ltr\">agencies, human rights, humanitarian and development actors and donors, <\/span><\/span><span id=\"page7R_mcid233\" class=\"markedContent\"><span dir=\"ltr\">stateless people and those at risk of statelessness face irreparable harm, <\/span><\/span><span id=\"page7R_mcid234\" class=\"markedContent\"><span dir=\"ltr\">undermining progress made in addressing this urgent human rights concern <\/span><\/span><span id=\"page7R_mcid235\" class=\"markedContent\"><span dir=\"ltr\">over the last decade. The COVID-19 pandemic highlights our collective and <\/span><\/span><span id=\"page7R_mcid236\" class=\"markedContent\"><span dir=\"ltr\">individual vulnerability, bringing into sharp focus the paramount importance <\/span><\/span><span id=\"page7R_mcid237\" class=\"markedContent\"><span dir=\"ltr\">of always promoting, protecting and fulfilling everyone\u2019s universal human <\/span><\/span><span id=\"page7R_mcid238\" class=\"markedContent\"><span dir=\"ltr\">rights, whoever we may be and whatever status we may have. In addition <\/span><\/span><span id=\"page7R_mcid239\" class=\"markedContent\"><span dir=\"ltr\">to demanding urgent and immediate action, the crisis provokes longer-term <\/span><\/span><span id=\"page7R_mcid240\" class=\"markedContent\"><span dir=\"ltr\">introspection and highlights the need for structural change. The time to <\/span><\/span><span id=\"page7R_mcid241\" class=\"markedContent\"><span dir=\"ltr\">build back better<\/span><\/span><span id=\"page7R_mcid242\" class=\"markedContent\"><span dir=\"ltr\"> for the world\u2019s stateless and those at risk of statelessness <\/span><\/span><span id=\"page7R_mcid243\" class=\"markedContent\"><span dir=\"ltr\">is now. We urge all stakeholders to take the following urgent actions:<\/span><\/span><\/p>\n<ol>\n<li><span id=\"page7R_mcid245\" class=\"markedContent\"><span dir=\"ltr\">Acknowledging and remedying past failures to address and dismantle <\/span><\/span><span id=\"page7R_mcid246\" class=\"markedContent\"><span dir=\"ltr\">discriminatory and degrading laws, policies and practices, which deny <\/span><\/span><span id=\"page7R_mcid247\" class=\"markedContent\"><span dir=\"ltr\">and deprive nationality while excluding, marginalising and penalising on <\/span><\/span><span id=\"page7R_mcid248\" class=\"markedContent\"><span dir=\"ltr\">discriminatory grounds; as well as failures to listen, to involve and ultimately <\/span><\/span><span id=\"page7R_mcid249\" class=\"markedContent\"><span dir=\"ltr\">be accountable to diverse stateless communities in identifying and <\/span><\/span><span id=\"page7R_mcid250\" class=\"markedContent\"><span dir=\"ltr\">implementing sustainable, fair, human rights-based solutions to the rights <\/span><\/span><span id=\"page7R_mcid251\" class=\"markedContent\"><span dir=\"ltr\">deprivations they endure.<\/span><\/span><\/li>\n<li><span id=\"page7R_mcid253\" class=\"markedContent\"><span dir=\"ltr\">Taking all necessary steps to ensure that stateless people are equally <\/span><\/span><span id=\"page7R_mcid254\" class=\"markedContent\"><span dir=\"ltr\">included in COVID-19 responses, that their particular contexts are recognised <\/span><\/span><span id=\"page7R_mcid255\" class=\"markedContent\"><span dir=\"ltr\">and addressed, their rights are upheld, and that they should not be penalised <\/span><\/span><span id=\"page7R_mcid256\" class=\"markedContent\"><span dir=\"ltr\">in any way, including by threat of harassment, arrest and detention, due to <\/span><\/span><span id=\"page7R_mcid257\" class=\"markedContent\"><span dir=\"ltr\">their lack of documentation or legal status, or any other aspect of their <\/span><\/span><span id=\"page7R_mcid258\" class=\"markedContent\"><span dir=\"ltr\">identity. Such steps should be taken, inter alia, with regard to vaccinations, <\/span><\/span><span id=\"page7R_mcid259\" class=\"markedContent\"><span dir=\"ltr\">healthcare, relief, livelihoods, education and civil registration. <\/span><\/span><\/li>\n<li><span id=\"page7R_mcid261\" class=\"markedContent\"><span dir=\"ltr\">Mainstreaming the right to nationality and the rights of stateless people <\/span><\/span><span id=\"page7R_mcid262\" class=\"markedContent\"><span dir=\"ltr\">as institutional priorities, through learning about statelessness and how <\/span><\/span><span id=\"page7R_mcid263\" class=\"markedContent\"><span dir=\"ltr\">it relates to respective mandates and obligations; resourcing responses, <\/span><\/span><span id=\"page7R_mcid264\" class=\"markedContent\"><span dir=\"ltr\">including the important work of stateless communities and NGOs; reporting <\/span><\/span><span id=\"page7R_mcid265\" class=\"markedContent\"><span dir=\"ltr\">on performance through human rights, development and other monitoring <\/span><\/span><span id=\"page7R_mcid266\" class=\"markedContent\"><span dir=\"ltr\">mechanisms; and redressing the intergenerational legacy and intersectional <\/span><\/span><span id=\"page7R_mcid267\" class=\"markedContent\"><span dir=\"ltr\">causes and consequences of statelessness, including by ensuring access
