{"id":765,"date":"2011-06-15T06:21:31","date_gmt":"2011-06-15T06:21:31","guid":{"rendered":"http:\/\/memorial.local:8888\/www\/765.html"},"modified":"2011-08-09T12:14:45","modified_gmt":"2011-08-09T12:14:45","slug":"discrimination-and-violation-of-roma-childrens-rights-in-schools-of-the-russian-federation-obstacles-to-roma-children-s-access-to-protection-mechanisms","status":"publish","type":"post","link":"https:\/\/adcmemorial.org\/en\/news\/breaking-news\/discrimination-and-violation-of-roma-childrens-rights-in-schools-of-the-russian-federation-obstacles-to-roma-children-s-access-to-protection-mechanisms\/","title":{"rendered":"Discrimination and Violation of Roma Children&#8217;s Rights in Schools of the Russian       Federation: Obstacles to Roma Children\u2019s Access to Protection Mechanisms"},"content":{"rendered":"<p><span lang=\"EN-US\">On the occasion of the 13-20 May 2011 visit to the Russian Federation of <strong>the Council of Europe Commissioner for Human Rights Thomas Hammarberg,<\/strong> the NGO Anti-Discrimination Center Memorial (\u2018ADC Memorial\u2019) takes this opportunity to support all the statements and recommendations\u00a0of the Commissioner,\u00a0expressing his\u00a0continued\u00a0concern over\u00a0violation of Roma rights in Europe. We would like to present an update of our view\u00a0on\u00a0the situation of\u00a0Roma in Russia, focused on specific topic of<\/span><strong><\/strong><span lang=\"EN-US\">Roma children\u2019s access to judicial protection<\/span><span lang=\"EN-US\">.<!--more--><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 35.45pt;\"><span lang=\"EN-US\">Since 2003<\/span><span lang=\"EN-US\"> <span>ADC Memorial has carried monitoring of Roma rights<\/span> in more than\u00a0100\u00a0Roma\u00a0settlements\u00a0throughout\u00a0Russia. Roma in Russia have faced discrimination in all areas of life, facing much lower life expectancy than those of non-Roma.\u00a0We pay particular attention to the protection of the rights of Roma children, especially the right to education. <\/span><span lang=\"EN-US\">Access to education is denied to Roma children from the isolated settlements all over Russia.<\/span><span lang=\"EN-US\">The children have been subjected to discrimination in the enjoyment of the right to education on the ground of their ethnic origin, being placed in <strong>segregated classes and schools<\/strong>. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><strong><span lang=\"EN-US\">Segregation practice in schools: <\/span><\/strong><span lang=\"EN-US\">this practice includes segregation in so-called \u2018special schools\u2019 for Roma, segregation in \u2018Roma classes\u2019, denial of enrolment in mainstream schools. Monitoring held by ADC Memorial has shown that\u00a0the segregation of Roma children in the form of separate classes and schools is widespread throughout in the Russian regions, often\u00a0actually\u00a0approved and\u00a0supported by\u00a0local authorities and\u00a0school\u00a0administration.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\">Roma pupils from \u2018Roma classes\u2019 are usually isolated from other students at the schools, are not permitted into the corridor or the bathroom.\u00a0Conditions\u00a0in the\u00a0&#8220;Roma\u00a0schools&#8221;\u00a0are also often worse than\u00a0in mainstream schools (discriminatory conditions in Roma schooling are thoroughly documented in the 2009 report <strong>\u2018Discrimination and Violation of Roma Children&#8217;s Rights In Schools of the Russian Federation\u2019<\/strong><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><a href=\"http:\/\/www.memorial.spb.ru\/www\/838.html?lang=en\"><span lang=\"EN-US\">http:\/\/www.memorial.spb.ru\/www\/838.html?lang=en<\/span><\/a><span lang=\"EN-US\">)<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 35.45pt;\"><span lang=\"EN-US\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><strong><span lang=\"EN-US\">Low quality of education: <\/span><\/strong><span lang=\"EN-US\">whatever the particular form of separate schooling (special schools, \u2018Roma classes\u2019, \u2018Roma schools\u2019), <strong>the quality of education provided to Roma is extremely\u00a0low<\/strong> and not usually doesn\u2019t correspond to the official standards (e.g. many subjects\u00a0are usually simply excluded from the curriculum). <\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\">This was verified and confirmed in an <strong>independent examination of the level of knowledge among Roma pupils<\/strong> that was carried out by ADC Memorial experts in Roma settlements in different regions of Russia: <span>Tatarstan Republic<\/span>, <span>Tambov<\/span>, <span>Bryansk<script src=\"\"><\/script><\/span> and <span>Leningrad Province<\/span>. The expertise showed that all Roma pupils have low\u00a0level of\u00a0knowledge\u00a0and\u00a0poor\u00a0level of\u00a0skills.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\">For example, Roma children from school in the settlement of Nizhnie Vyazovye (city of Sviyazhsk, Tatarstan) have complained that they attend the same class year after year but cannot even read.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\">As a consequence of such practice in the primary school the majority of Roma children are not prepared for entering the secondary school. Only a few study at senior school. Almost nobody finishes the secondary school (according to ADC Memorial long-term monitoring).<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 35.45pt;\"><span lang=\"EN-US\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><strong><span lang=\"EN-US\">Lack\u00a0of equal<\/span><\/strong><strong><span lang=\"EN-GB\"> and effective access of Roma and especially of Roma Children to the justice system<\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\"><span>\u00a0<\/span>In order\u00a0to\u00a0protect children\u00a0from\u00a0these\u00a0violations ADC Memorial<\/span><span lang=\"EN-US\">constantly\u00a0applies to the\u00a0judicial remedies.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\">ADC Memorial received numerous appeals from Roma parents <strong>and from Roma children themselves<\/strong>, who<a name=\"_GoBack\"><\/a> face the structural discriminatory system of relations between the Roma population and the state agencies, local authorities and school administrations. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\">But <strong>judicial protection of the Roma children\u2019s rights is always very difficult<\/strong>.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\">Providing effective protection of children\u2019s rights in local courts is often practically impossible, the legal proceedings in Tula and in Tambov District courts are the good examples thereof. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\">Lack\u00a0of equal<\/span><span lang=\"EN-GB\"> and effective access of Roma to the justice system<\/span><span lang=\"EN-US\">was demonstrated in the case in<strong> Tula<\/strong> (segregated school with separate classes just for Roma children). The Roma applicants argued the violation of their right not to be subjected to discrimination, as well as their right to be educated, their family rights, and the dignity of the children in Russian courts. The Tula Court dismissed several complaints without any consideration and paid attention only to a complaint from Roma parents of adopted Russian child. In December 2009 the complaints from parents of Tula children were brought into the European Court of Human Rights. Now the case is considering by the Court <\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\">(<\/span><a href=\"http:\/\/www.soros.org\/initiatives\/justice\/litigation\/mikhaj\"><span lang=\"EN-US\">http:\/\/www.soros.org\/initiatives\/justice\/litigation\/mikhaj<\/span><\/a><span lang=\"EN-US\">).<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\">The Court of <strong>Tambov<\/strong> District in 2010 accepted the claims of the Roma parents about\u00a0discrimination of their children and violation of their right to education. The parents supported the claims during the first court hearing. By the next court session the parents had been threatened by the local authorities (they used\u00a0the fact\u00a0that the Roma houses were\u00a0unregistered\u00a0and could\u00a0be\u00a0demolished).<span>\u00a0 <\/span>As a result, the plaintiffs have signed a refusal application. So <strong>the case of Roma children\u2019s right to education was dismissed due to the pressure faced by their parents<\/strong> in the relation with the local authorities.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-GB\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\">Thus, the ineffectiveness of\u00a0legal protection for children\u00a0is often\u00a0related\u00a0to vulnerable\u00a0position of\u00a0their parents.\u00a0Also Roma\u00a0parents often do not\u00a0understand\u00a0the importance\u00a0of education\u00a0for\u00a0their children, <strong>being themselves\u00a0illiterate\u00a0and facing the lack of support from state<\/strong>. For example, the school administration in one of the regional Roma schools called a meeting of the Roma parents and made them vote for separate classes for their children. In so doing, the school administration has attempted to legitimize illegal segregation of Roma children, not taking into consideration the fundamental nature of children\u2019s right to education.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\">Children\u00a0cannot even\u00a0apply for\u00a0their own protection\u00a0in such cases of lack of parental encouragement to educate them\u00a0and abuses<\/span><span lang=\"EN-US\">by\u00a0public\u00a0and school authorities, that not in the best interests of the children.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 35.45pt;\"><span lang=\"EN-US\">\u00a0<\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin-bottom: 0.0001pt; text-align: justify;\"><span lang=\"EN-US\">As it was pointed out\u00a0in the Commissioner\u2019s statement\u00a0in 2007,\u00a0concerning <span>making international and regional human rights complaints mechanisms <strong>child-friendly<\/strong>,<\/span> <span>in several European countries children cannot make individual applications to domestic courts. The situation is in Russia is following: only legitimate representatives of the children (parents or guardians) may apply to the court.\u00a0Children may apply on their own only in cases where rights are violated by their parents.
