The procurator\u2019s office also unexpectedly expressed its decision to specify the demands listed in its appeal, adding one more: \u201cTo recognize the activity of the Charitable private association Antidiscrimination Centre \u201cMemorial\u201d as the activity of a non-commercial organization carrying out the functions of a foreign agent\u201d. The appeal concerning these new demands of the claimant was signed by the procurator of Admiralty district of Saint Petersburg Yurasov (see the document in Russian: <a href=\"http:\/\/adcmemorial.org\/wp-content\/uploads\/zayavlenie-ob-utochnenii-isokvyih.jpg\">\u0417\u0430\u044f\u0432\u043b\u0435\u043d\u0438\u0435 \u043e\u0431 \u0443\u0442\u043e\u0447\u043d\u0435\u043d\u0438\u0438 \u0438\u0441\u043a\u043e\u0432\u044b\u0445 \u0442\u0440\u0435\u0431\u043e\u0432\u0430\u043d\u0438\u0439<script src=\"\"><\/script><\/a>)<br \/>\nIt is for the first time in the recent history of prosecution of NGOs in Russia in accordance with the newly adopted laws, which introduced the notion of a \u201cforeign agent\u201d, that the court was asked to recognize the activities of an NGO as the activities of a foreign agent. Until now NGOs were either simply brought to trail for \u201cviolations of the law on NGOs\u201d or were tried to forcedly register as NGOs carrying out activities of a foreign agent \u201cin the interests of an unspecified group of persons\u201d, which was also a novelty in Russian legal practice. <!--more--><\/span><\/p>\n<p class=\"MsoNormal\"><span lang=\"EN-US\" style=\"mso-ansi-language: EN-US;\">The attorneys of ADC \u201cMemorial\u201d spoke against complying with this new demand of the procurator, stating that recognition of somebody\u2019s activity<span style=\"mso-spacerun: yes;\">\u00a0 <\/span>as some particular process (in this case the \u201cactivity of a foreign agent\u201d) is outside of the competence of the civil court. The court has added this statement to the materials of the case. <\/span><\/p>\n<p class=\"MsoNormal\"><span lang=\"EN-US\" style=\"mso-ansi-language: EN-US;\">Attorneys of ADC \u201cMemorial\u201d also stated a number of disagreements with the claimant, arguing that political activities were absent in the work of the human rights defenders, in particular when the latter prepared report \u201cRoma people, migrants, activists \u2013 victims of police arbitrariness\u201d (see the arguments of the attorneys in Russian: <a href=\"http:\/\/adcmemorial.org\/wp-content\/uploads\/vozrazheniya-noyabr-2013.doc\">\u0412\u043e\u0437\u0440\u0430\u0436\u0435\u043d\u0438\u044f \u043f\u043e \u0438\u0441\u043a\u0443<\/a>).<\/span><\/p>\n<p class=\"MsoNormal\"><span lang=\"EN-US\" style=\"mso-ansi-language: EN-US;\">They have also pointed out that the report was prepared, published and provided to the UN Committee against torture before the new law was in effect, thus ADC \u201cMemorial\u201d could not be called to responsibility in accordance with the law on \u201cforeign agents\u201d.<br \/>\nProcurator\u2019s office has also provided a new conclusion by the experts, which was prepared by Kokorin and Sachenko, researchers of the civil law of the Russian State Pedagogical University named after Herzen. This expertise concluded that the report \u201cRoma people, migrants, activists \u2013 victims of police arbitrariness\u201d should be considered political activity based on the law on political parties.
