Among other things Mui\u017enieks pointed out the responsibility of the states and of all the government officials to react against ill treatment of people by the police officers, to prevent such cases and report about them: <em>\u201cPolitical leaders should instill the clear message that responsibility for ill-treatment extends beyond the actual perpetrators to anyone who knows, or should know, that ill-treatment is occurring and fails to prevent or report it.\u201d<script src=\"\"><\/script><\/em><\/span><\/p>\n<p><span lang=\"EN-US\">This statement is especially crucial for those organizations which, like ADC \u201cMemorial\u201d, are being <a href=\"http:\/\/adcmemorial.org\/www\/6998.html\/?lang=en\">persecuted by the state<\/a>\u00a0 for their attempts to react against police violence. \u00a0ADC \u201cMemorial\u201d raised these issues in a <a href=\"http:\/\/adcmemorial.org\/wp-content\/uploads\/report-POLICE-ABUSE_short-version-for-CAT-2012_ENG.pdf\">report <\/a>prepared to the UN Committee against torture.<\/span><\/p>\n<p><span lang=\"EN-US\">Nils Mui\u017enieks\u00a0 also stated that <em>\u201c excessive use of force during demonstrations and\/or apprehensions is, however, just the tip of the iceberg. Other forms of police misconduct occur out of the sight of the general public.\u201d<\/em> He went on to point out that <em>\u201canother serious form of police misconduct is violence targeting minorities, in particular Roma, and migrants. <!--more-->In <a href=\"https:\/\/wcd.coe.int\/ViewDoc.jsp?Ref=CommDH%282013%296&amp;Language=lanEnglish&amp;Ver=original&amp;BackColorInternet=B9BDEE&amp;BackColorIntranet=FFCD4F&amp;BackColorLogged=FFC679\">Greece<\/a>, for instance, regular threats and racially motivated ill-treatment of migrants and Roma by members of the police and coast guard have been reported. Institutionalized racism also plays a major role in ethnic profiling resulting in abusive stops and searches targeting minorities and migrants. In a recent report on <a href=\"http:\/\/www.opensocietyfoundations.org\/sites\/default\/files\/equality-betrayed-impact-ethnic-profiling-france-20130925.pdf\">France<\/a>, the Open Society Justice Initiative highlighted the very negative impact of this practice on \u201centire sectors of the population [who] are left feeling that no matter what they do, they will always be second-class citizens\u201d<\/em>.<\/span><\/p>\n<p><span lang=\"EN-US\">Thus, Commissioner for Human Rights of the Council of Europe admitted the importance of counteraction against police arbitrariness especially when defending the rights of vulnerable minorities, such as Roma people and immigrant workers. He stressed that this was not less important than defending the rights of activists during public assemblies. It was the problem of police arbitrariness aimed especially against \u201cRoma people, migrants and activists\u201d that the report of ADC \u201cMemorial\u201d was devoted to. This report resulted in a court ruling against ADC \u201cMemorial\u201d, which \u2013 contrary to any logic and legal grounds \u2013 <a href=\"http:\/\/adcmemorial.org\/www\/8435.html\/?lang=en\">ruled to declare<\/a> ADC \u201cMemorial\u201d a \u201cforeign agent\u201d.
