{"id":9262,"date":"2014-04-25T19:30:53","date_gmt":"2014-04-25T15:30:53","guid":{"rendered":"http:\/\/adcmemorial.org\/?p=9262"},"modified":"2014-05-10T12:58:36","modified_gmt":"2014-05-10T08:58:36","slug":"saint-petersburg-city-court-ruled-against-legal-appeal-by-adc-memorial-requiring-it-to-register-as-a-foreign-agent","status":"publish","type":"post","link":"https:\/\/adcmemorial.org\/en\/news\/saint-petersburg-city-court-ruled-against-legal-appeal-by-adc-memorial-requiring-it-to-register-as-a-foreign-agent\/","title":{"rendered":"Saint Petersburg city court ruled against legal appeal by ADC \u201cMemorial\u201d, requiring it to register as a \u201cforeign agent\u201d"},"content":{"rendered":"<p>The judicial panel of the Saint Petersburg city court, composed of presiding judge Gavrilova and judges Salnikova and Marina, ruled to decline <a href=\"http:\/\/adcmemorial.org\/www\/8574.html\/?lang=en\">ADC \u201cMemorial\u2019s\u201d appeal<\/a> against the earlier <a href=\"http:\/\/adcmemorial.org\/www\/9130.html\/?lang=en\">decision of Leninsky district court<\/a>, which had required ADC \u201cMemorial\u201d to get listed in the Ministry of Justice\u2019s register of \u201cNGOs performing functions of foreign agents\u201d.<\/p>\n<p><a href=\"http:\/\/adcmemorial.org\/wp-content\/uploads\/apellyatsionnoe-opredelenie-ADTS_gorsud_ENG.docx\">The ruling of Saint Petersburg city court<\/a> stated that ADC \u201cMemorial\u201d fell under the legal definition criteria of \u201cNGOs performing functions of foreign agents\u201d, because it had received foreign financing (Swedish International Development Cooperation Agency Sida was referred to as a source of funding) and was involved in political activities, namely preparing and disseminating the human rights report titled <a href=\"http:\/\/adcmemorial.org\/wp-content\/uploads\/report-POLICE-ABUSE_short-version-for-CAT-2012_ENG.pdf\">\u201cRoma, Migrants, Activists: Victims of Police Abuse\u201d<script src=\"\"><\/script><\/a><\/p>\n<p>The court\u2019s decision stressed that the aforementioned report contained recommendations on \u201cchanging or abolishing existing legislation, ratification of international legislative acts, adopting effective measures aimed at protection of foreign nationals (labor immigrants) from the arbitrary actions of state bodies and law enforcement agencies\u201d, as well as recommendations to \u201cbodies of international organizations and foreign intergovernmental organizations concerning the need to pursue Russia\u2019s signing and ratification of legally binding agreements, including those concerning juvenile justice and expansion of the rights of LGBT community\u201d. The court also found that this report \u201cgives justification of the legality of politically motivated activities by political activists, including organization of mass riots with a political agenda.
